Upon termination of the contract due to the tenant's death, only the following may subrogate the lease, in this order: the spouse who cohabited with the tenant, the children who had cohabited with the tenant for at least two years prior to death (unless they were minors), and other descendants, ascendants, or siblings with a minimum cohabitation period of two years.
The subrogation must be communicated to the landlord within three months of the death, providing proof of cohabitation.
The right of first refusal and the right of redemption exist. The tenant must be formally notified (registered letter with acknowledgment of receipt) stating the price, essential conditions, and the buyer's identity.
The tenant has 60 calendar days to exercise their right of first refusal; after this period, the sale can be completed.
